The Merit System Protection Board oversees the litigation process nationwide for many of the prohibited personnel practices taken by Agency officials against you. You are protected from unlawful and unfair treatment as a Federal employee.
If you are a Federal employee and suffered what is defined as a “Prohibited Personnel Practice” such as suspension over 14 days, demotion, termination or other retaliatory act you may need to file an appeal with the MSPB to protect your rights and future. This applies whether the action taken against you was for performance or conduct.
The MSPB process includes discovery, depositions, brief and motion writing, a hearing (similar to a bench trial) and can be very complex. Using experienced employment counsel familiar with the process may help your results.

MSPB appeal deadlines are very short and every day matters in calculating that deadline. Please be sure to read all Agency paperwork regarding any actions taken against you to ensure you are aware of those deadlines. While the deadline is typically 30 days from the effective date of the action or receipt date of the Agency’s decision, some deadlines, typically at the VA, may be as short as ten (10) days. It is important to ascertain that date.
